Terms of Service

Effective date: April 24, 2026

These Terms of Service ("Terms") govern your use of primitiv.design (the "Site") and the Primitiv waitlist (the "Waitlist"), operated by Ambit Labs Ltd, a company registered in England and Wales (company number 16980164) ("Primitiv", "we", "us"). By using the Site or joining the Waitlist, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who can use Primitiv

You must be at least 18 years old and legally able to enter a binding agreement. You must not be located in, or use Primitiv on behalf of anyone located in, a country subject to comprehensive sanctions (for example Cuba, Iran, North Korea, Syria, and the Crimea / Donetsk / Luhansk regions).

2. The service

primitiv.design is a marketing site for Primitiv, a design-contract layer for AI agents. The Waitlist is how we collect interest in early access to our forthcoming product. Joining the Waitlist does not create a purchase obligation, guarantee access, or form a contract for product delivery.

The Site and any early-access features are provided as is and as available. We may change, suspend, or discontinue any part of the Site at any time without notice.

3. Waitlist participation

When you submit the Waitlist form, you confirm that:

• The information you provide is accurate and yours.
• You have authority to submit on behalf of any organization you mention.
• You consent (via the form checkbox) to our processing your data per our Privacy Policy.

You can withdraw at any time by emailing hello@ambitlabs.ai.

4. Acceptable use

You agree not to:

• Scrape, crawl, or programmatically access the Site beyond reasonable browsing.
• Attempt to reverse-engineer, probe, or disrupt the Site or Waitlist.
• Submit false, misleading, or impersonating information.
• Use the Site to harass, abuse, or harm others.
• Interfere with security features or rate limits.
• Use automated means to submit the Waitlist form.

5. Intellectual property

The Site's content (design, code, copy, marks) is owned by Ambit Labs Ltd except where marked. The underlying Primitiv project includes open-source components; those are licensed separately under their respective licenses (linked from the Site and the project repository).

You retain ownership of any content you submit through the Waitlist. By submitting it, you grant us a limited, worldwide, royalty-free license to use it for the purposes described in our Privacy Policy.

6. Third-party services

The Site integrates with third-party services — Loops for email, Vercel for hosting and analytics, and, when active, PostHog for product analytics. Your use of those services is subject to their respective terms. We are not responsible for their conduct or availability.

7. Disclaimers

PRIMITIV IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR CONTINUOUS AVAILABILITY, TO THE FULLEST EXTENT ALLOWED BY LAW.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMBIT LABS LTD'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THE WAITLIST IS LIMITED TO ONE HUNDRED POUNDS (£100). WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES.

For consumers in the EU, UK, or other jurisdictions where these limitations are not permitted, nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable consumer-protection law.

9. Indemnification

You agree to indemnify and hold Ambit Labs Ltd harmless from any claims, damages, or expenses arising out of your breach of these Terms, your violation of applicable law, or your misuse of the Site. This clause does not apply to consumers where local consumer law prohibits it.

10. Termination

We may suspend or terminate your access to the Site or the Waitlist at any time, for any reason, including suspected violation of these Terms. You can stop using the Site at any time.

11. Governing law and disputes

These Terms are governed by the laws of England and Wales, without regard to its conflict-of-laws rules. Any dispute shall be brought in the competent courts of England and Wales. This does not limit any rights you may have under the mandatory consumer-protection laws of your place of residence; where such rights apply, you may bring proceedings in your local courts.

12. Changes

We may update these Terms from time to time. The updated version applies to use after the new effective date; material changes will be communicated by email (if you are on the Waitlist) or via a notice on the Site.
